उत्तर- भारतीय संविधान में 44वें संवैधानिक संशोधन द्वारा सम्पत्ति के अधिकार को मौलिक अधिकारों के अध्याय से निकालकर केवल कानूनी अधिकार बनाया गया। सम्पत्ति के अधिकार को मौलिक अधिकारों के अध्याय से निकालने अथवा हटाने का प्रमुख कारण उसका भूमि सुधार अधिनियमों के मार्ग में एक बड़ी रुकावट अथवा बाधा पैदा करना था। अतः भारत से जमींदारी प्रथा को उखाड़ फेंकने के लिए सम्पत्ति के अधिकार को मौलिक अधिकारों के अध्याय से हटाना परमावश्यक था। सम्पत्ति का अधिकार समाजवाद की स्थापना के रास्ते में भी रोड़ा अटका रहा था। समाजवाद एवं राष्ट्रीयकरण की नीति को लागू करने के लिए सम्पत्ति के अधिकार को मौलिक अधिकारों की सूची से हटा दिया गया।
